Terms and Conditions

These Terms and Conditions ("Terms") govern your purchase and use of the Bainbridge Adventures self-guided audio tours ("Tour"). By purchasing, downloading, accessing, or using the Tour, you agree to these Terms.
1. Self-Guided Tour
The Tour is a self-guided experience. Participants complete the Tour independently without a guide or employee present.
You are solely responsible for your own safety, transportation, decisions, and conduct throughout the Tour.
2. Driving Safety
Some tours require participants to drive between locations.
Drivers must:
• Obey all traffic laws and posted signs.
• Never operate a mobile device while driving.
• Pull over safely before interacting with the Tour, viewing maps, reading instructions, or making route changes.
• Never rely solely on the Tour for navigation.
Bainbridge Adventures is not responsible for traffic conditions, road closures, construction, accidents, parking availability, ferry schedules, navigation errors, or GPS inaccuracies.
3. Walking Safety
Participants are responsible for exercising caution while walking.
Always:
• Stay aware of your surroundings.
• Use marked crosswalks.
• Obey pedestrian signals.
• Watch for vehicles, bicycles, and other pedestrians.
• Wear appropriate footwear.
4. Assumption of Risk
Participation is entirely voluntary.
You assume all risks associated with participating in the Tour, including but not limited to:
• Motor vehicle accidents
• Pedestrian accidents
• Slips, trips, and falls
• Uneven sidewalks or trails
• Ferry travel
• Weather conditions
• Wildlife
• Construction
• Closed businesses
• Crowds
• Injuries caused by third parties
5. Release of Liability
To the fullest extent permitted by law, Bainbridge Adventures, its owners, employees, contractors, affiliates, and partners are not liable for any injury, illness, death, property damage, theft, loss, delay, inconvenience, or other damages arising from participation in the Tour, except where liability cannot legally be excluded.
6. Vehicles
If you choose to drive during the Tour, you are solely responsible for:
• Operating your vehicle safely.
• Maintaining valid insurance.
• Holding a valid driver's license.
• Parking legally.
• Paying all parking fees, tolls, ferry fares, citations, and fines.
7. Personal Property
Participants are responsible for all personal belongings.
Bainbridge Adventures is not responsible for lost, stolen, or damaged property.
8. Children
Parents and legal guardians are responsible for supervising children at all times.
9. Weather
Tours operate year-round.
Weather conditions may affect your experience. You are responsible for determining whether conditions are safe for participation.
No refunds will be provided due to weather.
10. Attractions and Businesses
Businesses, attractions, artwork, trails, ferry schedules, operating hours, admission fees, parking, accessibility, and public facilities may change without notice.
Bainbridge Adventures does not guarantee that any stop will be open or available.
11. No Refund Policy
All sales are final.
Because access to digital content is provided immediately after purchase, no refunds, exchanges, credits, or cancellations will be issued.
12. Technology
Participants are responsible for providing:
• A compatible mobile device.
• Adequate battery life.
• Internet or cellular service if required.
• GPS capability.
• Headphones if desired.
Bainbridge Adventures is not responsible for technical failures, software compatibility, poor cellular coverage, GPS inaccuracies, or device malfunctions.
13. Intellectual Property
The Tour, including audio recordings, photographs, maps, graphics, text, routes, and other content, is protected by copyright and other intellectual property laws.
Purchasing the Tour grants you a personal, non-transferable, non-commercial license to use the Tour.
You may not copy, distribute, reproduce, record, share, sell, publish, or create derivative works from any portion of the Tour.
14. Limitation of Liability
To the fullest extent permitted by law, Bainbridge Adventures' total liability for any claim relating to the Tour shall not exceed the amount paid for the Tour.
15. Indemnification
You agree to defend, indemnify, and hold harmless Bainbridge Adventures, its owners, employees, contractors, affiliates, and partners from any claims, liabilities, damages, losses, costs, or expenses arising from your participation in the Tour or your violation of these Terms.
16. Governing Law
These Terms are governed by the laws of the State of Washington.
Any legal action arising from these Terms shall be brought exclusively in the courts of Kitsap County, Washington State.
17. Changes
Bainbridge Adventures may update these Terms at any time without prior notice. Continued use of the Tour constitutes acceptance of the updated Terms.
18. Acceptance
By purchasing or using the Tour, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
